Divorce affects the couple and children (if any). The divorce is the most serious social problem that affects almost the entire life of the children and the couple, it also makes troubles like: sadness, despair, and unforgettable moments (Williams, 2013). In this paper, I will be discussing the factors contributing to divorce in Canada and will also explain certain statistics used as well. The methodologies that I will be using are both the qualitative and quantitative approach. The reasons I am using both of them are because by using the quantitative research, I will develop mathematical hypotheses pertaining to the phenomena. Also to analyze this topic with the use of statistics to make it somewhat accurate, while for quantitative; because it will explain in word data about my information. I strongly believe that these two forms of methodology will properly explain the factors contributing to divorce. The history of the legalization of divorce in Canada predates that of its colonial overseer, England, where it was only in 1857 that divorce was legislated, mainly on grounds of adultery. Nova Scotia, New Brunswick, and Prince Edward Island respectively enacted divorce laws in 1761, 1791, and 1837, generally on grounds of adultery (Wu Schimmele, 2009). It was not until 1968 that Canada enacted its first unified Federal Divorce Act, which was followed by the more liberal or no fault act of 1985 and it was mentioned that the sole reason for divorce is marriage breakdown, which is defined as either living apart for at least one year, or committing adultery, or treating the other spouse with physical or mental cruelty. Though divorce rates have not increased recently in Canada, the number of divorced persons is however increasing with population growth. In 2007, there were 972,183 divorced women and 712,531 divorced men in the population (Statistics Canada, 2007). The study found that there was strong positive relation among Perceived usefulness, perceived ease of use and users attitudes towards the intranet. And the Attitude has strong relation with the user intention to use. And the intention to behave had a strong relation with the actual usage this conform the positive significant relation in TAM and its constructs are to predicting the user acceptance of the intranet/portal. Even there are relation between experience and perceived usefulness and perceived ease of use. Even experience is a stronger predictor for perceived ease of use and perceived usefulness than age does. So, Technology Acceptance Model (TAM) which created by (Davis Bagozzi Warshaw, 1989; Davis et al., 1989) Studied some important factors affecting in the use of the information technology. the TAM explained how the behavior intention to use the technology effected by one basic factor to cause the actual use for the new system, therefore the behavior intention to use the technology is the merely or only determined related to actual use for the system, beside that the latest studies confirmed that the behavior intention to use the technology is the merely mediated factor. Nursing Facilitator Model

Nursing Facilitator Model Evaluation of the Practical Implication of Implementing this Model: I can utilise this nursing facilitator model in my own workplace which is a medical ward but share multiple care setting at times. I am an active nursing member of the ward which gives me an opportunity to share my beliefs and model with other members in the ward for the improvement of the care. This model specifically focuses on four corners of nursing which can be easily accepted in general cares and help eliminate various confusion during the practice.It is constructed in a simple way. I also work as a diabetic representative of the ward. Hence, I get chances to interact with nurses of various wards during the meetings and this inflates my chances to explore the education to them. The easy method to expose this model among my colleagues at work is via ward meeting. Support from the leaders and opportunity to use them in real life settings is essential too. Not only this I can consult with the senior nurses of the hospital about their beliefs in the model and consume my model of care through their support.From my experience of working in a busy emergency to a quiet palliative setting, I am confident that this model will equally benefit to develop the proficiency of nursing and help boost patient care. They are quite excited to know my model and voiced that they are inspired by this model to use it in routine nursing cares. This will be implemented in various settings to be considered successful after being accepted by the members of my workplace who are willing to accept change in their daily life.This model help nurses to foresee their duty of care remaining within the scope of practice and accept the accountability of their action. This model is based on evidence-based practice and is completely based on the patient and health care needs. It consists of the concepts of real life practice without providing major effort to use in an individual practice. My experience of nine years of nursing in various sectors in different countries has explored the basic need of nursing as experience and education equally, valuing critical thinking skills, technical skills and knowledge on legal circumstances.This model will also assist to reduce the gap between the patient and nurse relationship. The long term influences will be to enhance the healing process of the patient, giving them satisfaction during their short hospital stay and nurses without being burnt down. My model suggests holding the legal and ethical boundary in the meantime. One of the crucial parts of nurses is accepting the responsibility and being accountable to the responsibility remaining within their scope of practice. This model is designed to be adapted by all the nursing members of my workplace.This model identify nurses need to learn through evidence based practice and reflection from the colleagues past experience. It should make individual difference in the caring attitude and care pattern to the patient in the small ward like ours. This model will be put in the notice board after discussed and informed to the colleagues and senior staffs of the ward. Therefore it will provide me the chance to receive advice or alter any changes if needed from the other members of the team. Once the effectiveness has been achieved, it will be published in a newsletter after gaining further interests from other wards too.This model is economically feasible in the private health care system due to managerial support of further education and quality improvement of the care. The other factors such as cultural background, religion, spirituality, individual level of understanding, family and peer support, community help and communication affects the nursing facilitator model. What is missing in my model? I have not considered artistic and interpretive reflection in this model but I have included experiential reflectivity. The neutral interpretative reflection guides nurses with div ersity of decision making skills and enhance their experience.Self reflection is an effective method of gaining knowledge. I think interpretive reflection is equally important to consider learning pathway in nursing. However, I think it might be the cause of misinterpretation of things at times. Sometimes it gets out of context and leads to negativity. There are further needs of developing the tools for this model. Is this model financially feasible? All the residents and citizens of Australia have current Medicare to cover their medical bills. I currently work in a private hospital of Australia and most of patients here are covered with private health cover.This model is designed for the adult health care system and different circumstances will be needed in other settings such as child birth and paediatric care. Consent will be taken first before the implementation of the facilitator model. The hospital where I work is considered as one of the biggest private hospital of the area. Therefore, it is financially feasible model. There will be a questionnaire developed to conduct the follow up result of the tests. It will include the quality of care; time consumed and further advises to improve the care design.The follow up can be attended though mails, emails or even telephone according to the desire of the patient and family. I found that the most stimulating area of this model is geriatric care setting; hence my main focus will be elderly patients. Not only that the majority of age group admitted in the medical ward are geriatric patients. In most of the public hospital there is a combined funding from community health, Government of health and ageing Australia and specific funding such as palliative care funding.This ward had private health care funding as well as government supported funding. Actions seem to be taken place in the case of elderly abuse at times but most of the times it is missed due to the cognitive issues such as dementia in majority of them. The trial will be commenced from the geriatric ward before formulating on any other wards such as surgical or paediatric ward. This model will require second weekly follow up to gain the feedback of the model and review the response from the other support services. Can the Nursing Facilitator Model improve nursing care in my area of work?This is a simple model that represents the central beliefs of nursing in a general ward setting. I look forward to present this nursing facilitator model in my area of work after developing the testing tools. Wensha vs Yung Case Digest

G. R. No. 185122 August 16, 2010 WENSHA SPA CENTER, INC. and/or XU ZHI JIE, Petitioners, vs. LORETA T. YUNG, Respondent. A petition for review on certiorari under Rule 45 of the Rules of Court filed by an employer who was charged before the National Labor Relations Commission (NLRC) for dismissing an employee upon the advice of a Feng Shui master. Facts: Wensha Spa Center, Inc. (Wensha) in Quezon City is in the business of sauna bath and massage services. Xu Zhi Jie a. k. a. Pobby Co (Xu) is its president,3 respondent Loreta T. Yung (Loreta) was its administrative manager at the time of her termination from employment.Loreta recounted that on August 10, 2004, she was asked to leave her office because Xu and a Feng Shui master were exploring the premises. Later that day, Xu asked Loreta to go on leave with pay for one month. She did so and returned on September 10, 2004. Upon her return, Xu and his wife asked her to resign from Wensha because, according to the Feng Shui master, her au ra did not match that of Xu. Loreta refused but was informed that she could no longer continue working at Wensha. That same afternoon, Loreta went to the NLRC and filed a case for illegal dismissal against Xu and Wensha.Labor Arbiter (LA) Francisco Robles dismissed Loreta’s complaint for lack of merit. He found it more probable that Loreta was dismissed from her employment due to Wensha’s loss of trust and confidence in her. NLRC affirmed in its Resolution,9 citing its observation that Wensha was still considering the proper action to take on the day Loreta left Wensha and filed her complaint. CA reversed the ruling of the NLRC on the ground that it gravely abused its discretion in appreciating the factual bases that led to Loreta’s dismissal. The CA noted that there were irregularities and inconsistencies in Wensha’s position.Issue: Whether or not petitioner Xu Zhi Jie is solidarily liable with Wensha. Ruling: Loreta’s security of tenure is guaran teed by the Constitution and the Labor Code. Under the security of tenure guarantee, a worker can only be terminated from his employment for cause and after due process. The records are bereft of evidence that Loreta was duly informed of the charges against her and that she was given the opportunity to respond to those charges prior to her dismissal. If there were indeed charges against Loreta that Wensha had to investigate, then it should have informed her of those charges and required her to explain her side.Wensha should also have kept records of the investigation conducted while Loreta was on leave. The law requires that two notices be given to an employee prior to a valid termination: the first notice is to inform the employee of the charges against her with a warning that she may be terminated from her employment and giving her reasonable opportunity within which to explain her side, and the second notice is the notice to the employee that upon due consideration of all the cir cumstances, she is being terminated from her employment. This is a requirement of due process and clearly, Loreta did not receive any of those required notices.Nevertheless, the Court finds merit in the argument of petitioner Xu that the CA erred in ruling that he is solidarily liable with Wensha. Elementary is the rule that a corporation is invested by law with a personality separate and distinct from those of the persons composing it and from that of any other legal entity to which it may be related. â€Å"Mere ownership by a single stockholder or by another corporation of all or nearly all of the capital stock of a corporation is not of itself sufficient ground for disregarding the separate corporate personality. In labor cases, corporate directors and officers may be held solidarily liable with the corporation for the termination of employment only if done with malice or in bad faith. Bad faith does not connote bad judgment or negligence; it imports a dishonest purpose or some moral obliquity and conscious doing of wrong; it means breach of a known duty through some motive or interest or ill will; it partakes of the nature of fraud. In the subject decision, the CA concluded that petitioner Xu and Wensha are jointly and severally liable to Loreta.We have read the decision in its entirety but simply failed to come across any finding of bad faith or malice on the part of Xu. There is, therefore, no justification for such a ruling. To sustain such a finding, there should be an evidence on record that an officer or director acted maliciously or in bad faith in terminating the services of an employee. Moreover, the finding or indication that the dismissal was effected with malice or bad faith should be stated in the decision itself.

The availability of so many substitutes products indicates that risk of consumers switching to a different industry (other than Internet Search Industry) are extremely high. This incident has charged BP with the clean-up costs, economic and natural resources’ damage costs, Clean Water Act (CWA) penalties etc probably leading to approximately $41 billion (Ramseur & Ramseur, 2011, p.1). The initial estimate of the oil spill was 1000 barrels per day which was later revised at up to 60,000 barrels per day (Hiles, 2011, pp.13). Impact of Festivals Robyn Ormond Introduction: South Africans love festivals, it is a chance to ‘let loose’ and enjoy a time of fun, family and by the end, usually no funds. Festivals can be described in many ways, namely â€Å"events of limited duration developed primarily to enhance the awareness, appeal and profitability of a tourist destination† (Ritchie, 1984: 2). Festivals have become a vital component of tourism in small towns (Visser, 2005). The importance of annual festivals in two South African towns, being Sedgefield (the Sedgefield Slow-Festival) and Knysna ( Knysna Oyster Festival) as well as the economic importance of these festivals will be explored to show how festivals can prevent the decline of these iconic towns. Decline def The Importance of Festivals Festivals are more than just a way of making money, there is a deeper impact of festivals upon the communities who host them, these festivals can then rather be referred to as â€Å"a public, themed celebration† (Jackson et al, 2005). Festivals which occur in smaller town like the two that will be analysed normally have a strong sense of community and by holding a festival, ideals such as leadership and accountability of the locals are promoted, members of the community are encouraged to get involved and to take responsibility with regards to the planning and running of the festival (Visser, 2005). This act of holding a festival strengthens the community and allows for bonds of friendship to form between the town members as community goals are achieved through the management of the festival (Saayman A, Saayman, M, 2006). The festival also allows for the natural beauty of the towns to be appreciated and act as a platform for conservation and environmental protection (especially in Sedgefield and Knysna, both of which occur along South Africa’s prestigious Garden Route) (Visser, 2005). Festivals not only create links within the community but strengthens ties with that of the world around them (people from much larger cities- Cape Town and Johannesburg are willing to travel to come and participate in the festivals held in Knysna and Sedgefield.) (Saayman A, Saayman, M, 2006). The strong community bond a festival creates can help prevent the town from going into decline by becoming an attractive place to live and especially to retire to. The Economic Importance of Festivals: Not only are festivals important for growing a town’s identity but these celebrations are known to bring a healthy influx of money into the town. Festivals can boost a towns economy by either extending the current seasonal income (money made during peak tourism times in the town- usually correlating with holidays) or by creating an entirely new tourism season (Visser, 2005). The economic impact of a festival on a small town is simple; people come from outside the town and by participating in the festival, spend money which goes directly towards the local economy of the town (Saayman A, Saayman, M, 2006). Tourism is the driving force behind a festival and the more a town can offer in terms of tourism, the more attractive the festival will be. Festivals are a way of a town advertising itself to the outside world in the hopes of attracting people willing to settle there or foreign investors to take an interest in the town (Saayman A, Saayman, M, 2006). The money generated from a festival is used in a small town to help ensure sustainability of the town and to help the town regenerate (if it had previously gone through a period of decline) (Saayman A, Saayman, M, 2006). A tourist spending money in the town during a festival has an impact on a variety of sectors due to the interlinked nature of the tourism industry (a tourist will need to purchase food and drink during the festival, have access to accommodation as well as pay to participate in the events of the festival, this will benefit a large number of businesses in the town) (Saayman A, Saayman, M, 2006). For the two festivals bei ng explored, a large portion of the proceeding is donated to charity, as the community of Sedgefield and Knysna are more people-orientated and less money-driven. The Sedgefield Slow Festival: The Sedgefield slow festival is a celebration of life in a small town only 7.85 km ² in size with a population of 8286 (Firth, 2011) along the Eastern Cape of South Africa. The town advertises itself as South Africa’s self-proclaimed â€Å"Slow Town† (as nothing will happen at a speed faster than a tortoise’s walk- the icon of Sedgefield). The local residents volunteer to be part of a committee who are dedicated to creating a festival which promotes â€Å"Wholesome goodness, Family, Friends, Fun, the Outdoors and Great food† (Dixon, 2014). The festival is young in comparison to other South African festivals with its birth in 2010. The objective of the festival is to show off the natural beauty of the area in a way that will get the entire town involved while creating local economic opportunities at the same time (Dixon, 2014). The town hosts several events during the festival including the infamous â€Å"Anything-That-Floats Race† (a water race where participants must build crafts constructed entirely out of recycled materials). Other events include a Beer-Pong competition held at one of the local bars as well as the Town Hall Arts Exhibition. In total there are about twenty five events held over the three days surrounding the Easter weekend (18-20 April in 2014) (Dixon, 2014). In 2013 the proceeds from a variety of events, market sales (in the local farmers’ and craft market) and donations, the Slow-festival was able to support four different charities (Sedgefield Hospice, Sedge Mobile Meals, KAWS and Masithandane) with R12000 over the three day festival (Dixon, 2014). The Knysna Oyster Festival: Only 25km away from Sedgefield is the town of Knysna. Every year around the first week of July the Pick n Pay Knysna Oyster Festival is held over a ten day period (Knysna Oyster Festival, 2014). This festival is much older than the Sedgefield Slow-Festival with its debut in 1983. The purpose of the festival was originally to bring people to the area during the off-peak winter period; subsequently the festival has experienced a large amount of success and has grown significantly since its origin (Knysna Oyster Festival, 2014). The festival places a great emphasis on supporting charities, and due to the large nature of the festival, a sizeable amount of money can be donated. In 2013 the festival was able to generate R1 million which would benefit the community and have a significant impact on the local charities (Knysna Oyster Festival, 2014). Before an event can be registered as an official event of the Oyster Festival it must first state which charity or non-governmental organisation it will be supporting with a portion of its proceeds (Knysna Oyster Festival, 2014). Out of the many events held over the ten days, the three most iconic are the Momentum Weekend Argus Rotary Knysna Cycle Tour (which is one of the largest road and mountain bike races in South Africa), the Momentum Cape Times Knysna Forest Marathon and Half Marathon and of course the oysters which are eaten over the duration of the festival (which can reach up to 20000 oysters consumed) (Knysna Oyster Festival, 2014). Conclusion: Festivals in small towns (especially in South Africa) are events in which the entire community can be involved in the planning, managing and running of the festival. These festivals are able to boost the local economy and generate a flow of capital in times which would otherwise be regarded as off-peak quiet periods characterised by little tourism and lower income for the community members. These festivals such as the Sedgefield Slow-Festival and the Knysna Oyster Festival create an identity for the town whilst forming community bonds between the residents. The large charity component of both the Sedgefield Slow-Festival and the Knysna Oyster Festival allows for all in the community to benefit from the proceeds.
